Copyright Policy

1. General Information

1.1 Sword and Cross Apps Pty Ltd (“SCA”) is the creator of the smart-watch application PTSDPal™ (“the App”) as a Paid App Service (“the Service”). Installation and use of the App by an individual (interchangeably referred to as “you” or “the user”) is governed by the terms and conditions of the End User Licence Agreement between SCA and the user.

1.2 By downloading, accessing, or using the App, the user also signifies their assent to this Copyright Policy.

1.3 The user is directed to carefully review the SCA End User Licence Agreement available at https://ptsdpal.com prior to installing and using the App. The terms used in this Copyright Policy have the same meanings as in the End User Licence Agreement.

1.4 If the user does not agree with the terms and conditions of the End User Licence Agreement, or this Copyright Policy, the user should not complete the installation process, or continue to use the App.

2. Acceptable Use

2.1 All intellectual property rights in the App including text, graphics, video clips, logos, icons, images, music, audio clips, video clips, software, data compilations, and any other forms of content or information (collectively referred to as “The App Content”) are retained by SCA. All rights not expressly granted are reserved by SCA.

2.2 The App Content is the intellectual property of SCA.

2.3 The App Content may not be duplicated, copied, modified or adapted, in any way without written permission.

2.4 Use of the App does not constitute any right or license for the user to use our service marks or trademarks, without the prior written permission of SCA.

2.5 The App Content is protected under the Copyright Act 1968 (Cth). The copying, redistribution, use or publication by you of any such content is strictly prohibited. Your use of the App does not grant you any ownership rights to the content.

3. User Prohibitions

3.1 The user must not under any circumstances:

3.1.1 use the App in any way or take any action that causes, or may cause, damage to the app or impairment of the performance, availability or accessibility of the app;

3.1.2 use the App in any way that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity;

3.1.3 use the App to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software; or

3.1.4 use the App to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software; or

3.1.5 conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our app without our express written consent.

4 Report of Breach

4.1 If you found any unlawful material or activity on our app, or any material or activity that breaches this notice, please let us know. You can let us know about any such material or activity by email us at [email protected]

5 Enforcement of Copyright

5.1 Upon discovery of a contravention to this Copyright Policy, SCA may bring legal proceedings against you, seeking monetary damages and/or an injunction to stop you using those materials. You could also be ordered to pay legal costs.
